These Terms & Conditions apply to all bookings, photography sessions, website use, digital image delivery, gift cards, promotional offers, and related services provided by My Travel Pix.
By browsing our website, requesting a booking, paying an invoice, purchasing a photography package, attending a photography session, receiving images, or otherwise using our services, you agree to be bound by these Terms & Conditions.
1. Definitions
In these Terms & Conditions:
“My Travel Pix,” “we,” “us,” or “our” means My Travel Pix, the business providing and coordinating the photography services described in these Terms.
“Client,” “you,” or “your” means the person booking, purchasing, attending, receiving, or using our services, including any person on whose behalf a booking is made.
“Photographer” means an independent photographer, contractor, or service provider assigned or arranged by My Travel Pix to perform a photography session.
“Photography Session” means the scheduled photo shoot, travel photography session, vacation photography experience, family photography session, couple photography session, event-style photography session, or other photography service booked through My Travel Pix.
“Services” means our website, booking coordination, photography session arrangements, photographer assignment, image editing coordination, online gallery delivery, digital download access, gift cards, promotions, and any related services offered by My Travel Pix.
“Website” means any website, booking platform, landing page, online gallery, social media booking page, or digital platform operated or authorised by My Travel Pix.
“Third Party” means any external provider, platform, payment processor, print supplier, travel advisor, venue, transport provider, accommodation provider, gallery host, or other third-party service provider involved in or connected to the Services.
2. Our Services
My Travel Pix provides travel and vacation photography services by coordinating photography experiences with selected independent Photographers in various destinations.
Our Services may include:

browsing packages and destination information
-
submitting a photography session request
-
coordinating availability with a Photographer
-
issuing invoices and payment links
-
confirming session date, time, and meeting location
-
assigning a suitable Photographer
-
arranging post-production and editing
-
delivering edited digital images through an online gallery
-
offering optional additional shooting time or extra services
-
providing gift cards, promotions, or related products where available
My Travel Pix may work with independent Photographers who are not employees of My Travel Pix. Photographers are engaged as independent service providers.
We aim to assign a Photographer suited to your requested destination, package, style preferences, timing, and availability. However, we do not guarantee that any specific Photographer shown on our website or social media will be assigned to your booking.
We may replace or reassign a Photographer at any time before the Photography Session for operational, logistical, health, safety, weather, availability, professional, or other reasonable reasons. A Photographer replacement does not automatically entitle you to cancel, receive a refund, or claim compensation.
3. Eligibility
You must be at least 18 years old to make a booking or purchase Services from My Travel Pix.
If you make a booking on behalf of another person, family, group, company, travel client, or third party, you confirm that you are authorised to accept these Terms & Conditions on their behalf.
4. Booking Process
A booking is not confirmed until:

availability has been confirmed by My Travel Pix;
-
My Travel Pix has issued an invoice, payment link, or booking confirmation;
-
full payment has been received as cleared and undisputed funds; and
-
My Travel Pix has issued written confirmation of the booking.
Your preferred date, time, Photographer, and location are not guaranteed until your booking is confirmed in writing.
After payment is received, My Travel Pix will provide booking details such as:
-
confirmed date and time
-
meeting point or location instructions
-
Photographer details, where applicable
-
package details
-
relevant preparation notes
-
any specific location or access information
You are responsible for checking all booking details and notifying us promptly of any errors.
5. Acceptance of Terms
By paying any invoice, payment request, booking fee, package price, gift card, or other amount to My Travel Pix, you confirm that you:
-
have had the opportunity to read these Terms & Conditions;
-
understand that payment confirms your acceptance;
-
agree that these Terms apply to your booking;
-
accept these Terms whether you paid personally or through a third party.
If a travel advisor, concierge, family member, event planner, company representative, destination management company, or any other intermediary makes payment on your behalf, that person is deemed authorised to accept these Terms for you.
Failure to read or understand these Terms does not release you from their effect once payment has been made.
If you have questions, you must ask My Travel Pix before making payment.
6. Prices and Currency
All prices charged by My Travel Pix are stated in United States Dollars (USD) unless clearly stated otherwise.
You are responsible for any additional costs charged by your bank, card issuer, payment provider, or financial institution, including:

currency conversion fees
-
international transaction fees
-
card processing fees
-
bank fees
-
payment platform charges
-
exchange rate differences
My Travel Pix is not responsible for exchange rate changes or fees imposed by third parties.
Prices, packages, inclusions, fees, surcharges, and promotions may change at any time without prior notice. Price changes will not affect bookings that have already been confirmed and fully paid.
7. Public Holiday and Special Date Surcharges
Photography Sessions scheduled on national public holidays, local public holidays, bank holidays, religious holidays, major events, festival periods, peak travel dates, or other high-demand dates may be subject to an additional surcharge.
Unless otherwise stated in writing, a public holiday or special date surcharge of USD 300 may apply.
Any applicable surcharge will be communicated before booking confirmation where reasonably possible.
8. Photographer Availability
All Photography Sessions are subject to Photographer availability.
We recommend booking at least 7 days in advance. For weekends, holidays, peak travel seasons, popular destinations, sunrise sessions, sunset sessions, or special events, we recommend booking further in advance.
My Travel Pix will try to accommodate your preferred date, time, and location, but cannot guarantee availability.
If we are unable to arrange a suitable Photographer, date, or time after payment has been made, we will provide a refund of the amount paid for the Photography Session, excluding any transaction, conversion, banking, or third-party processing fees that cannot be recovered.
9. Contact Details and Communication
You are responsible for providing accurate contact information, including your email address, phone number, messaging app details, accommodation details, and any other required contact details.
My Travel Pix is not responsible for missed communications, lost confirmations, delays, or failed delivery where you provide incorrect contact details or fail to check your email, spam folder, junk folder, messaging apps, or phone.
Most communication may occur electronically, including by email, website forms, payment links, SMS, WhatsApp, or other digital methods.
By booking with My Travel Pix, you consent to receiving booking-related communications electronically.
10. Transfer of Bookings
Bookings may be transferred to another person before the Photography Session date, subject to written notice to My Travel Pix.
Any transfer request must be made in writing and must include the full details of the new participant or recipient.
My Travel Pix may refuse a transfer where it is not practical, lawful, safe, or operationally possible.
11. Session Length
Photography Session lengths are approximate and based on the package purchased.
Session time may include walking between locations, minor delays, coordination time, and changes caused by weather, crowd conditions, venue restrictions, access issues, or safety concerns.
Any itinerary, route, shot list, or schedule provided before the session is indicative only and may be adjusted by the Photographer based on professional judgment, safety, lighting, timing, crowds, access, and local conditions.
12. Additional Time and Extra Services
You may request additional photography time during the session, subject to:

Photographer availability;
-
My Travel Pix approval;
-
operational feasibility;
-
payment of additional fees.
Approved additional time or extra services will be invoiced separately. Payment must be completed within 24 hours after the Photography Session unless otherwise agreed in writing.
Additional images, extended galleries, retouching, upgraded packages, or other extras will only be delivered after full payment has been received.
13. Client Responsibilities
You are responsible for:

arriving on time;
-
being ready at the agreed meeting location;
-
ensuring all participants are aware of the booking details;
-
obtaining any required permissions for private venues or restricted locations;
-
paying entry fees, transport costs, permits, location fees, or activity costs where applicable;
-
supervising children, dependants, pets, or vulnerable persons;
-
following safety instructions from the Photographer;
-
behaving respectfully toward the Photographer, third parties, venue staff, and the public;
-
notifying us in advance of mobility, accessibility, timing, cultural, clothing, privacy, or safety requirements.
If you arrive late, the session may still end at the scheduled finish time. Late arrival does not entitle you to a refund, extension, reshoot, or discount.
14. Location Descriptions and Access
My Travel Pix may provide suggestions, sample itineraries, destination descriptions, location images, or promotional examples. These are provided for guidance only.
Actual locations may differ due to:

construction works
-
weather
-
crowd levels
-
seasonal changes
-
public events
-
access restrictions
-
local regulations
-
venue closures
-
safety concerns
-
lighting conditions
-
traffic or transport disruption
Photos shown on our website or social media are examples only. They do not guarantee the exact appearance, lighting, weather, crowds, route, results, or final image style of your Photography Session.
15. Weather Policy
My Travel Pix sessions are designed to proceed in normal weather conditions where it is safe and practical to do so, including cloudy weather, moderate temperatures, and light rain.
Safety always comes first.
Severe weather may include:
-
thunderstorms
-
lightning
-
snowstorms
-
blizzards
-
hurricanes
-
tornadoes
-
floods
-
extreme wind
-
dangerous heat
-
wildfires
-
government warnings
-
unsafe environmental conditions
-
other serious events beyond our reasonable control
If My Travel Pix or the assigned Photographer determines that weather makes the session unsafe, impossible, or commercially unreasonable to perform, My Travel Pix may, at its discretion, offer one of the following:
-
rescheduling to another suitable time or date, subject to availability;
-
relocation to a safer or more suitable indoor or covered location;
-
a voucher equal to the amount paid, valid for 12 months;
-
written confirmation of cancellation for your travel insurance provider.
No cash refund is payable for cancellations caused by severe weather or force majeure events beyond our reasonable control.
If light rain, intermittent showers, clouds, wind, or other manageable conditions do not prevent the session from being performed safely, the session may proceed. The Photographer may adjust the route, timing, or location.
If My Travel Pix or the Photographer offers a reasonable alternative and you refuse it, the session may be treated as cancelled by you and no refund, credit, compensation, or reshoot will be due.
My Travel Pix and/or the Photographer will make the final decision about whether weather conditions permit the session to proceed safely.
16. Force Majeure
My Travel Pix is not liable for failure to perform or delays caused by events outside our reasonable control.
Force majeure events may include:

natural disasters
-
severe weather
-
pandemics or epidemics
-
border closures
-
government restrictions
-
war
-
terrorism
-
civil unrest
-
strikes
-
transport shutdowns
-
public health orders
-
venue closures
-
internet or platform outages
-
fire
-
flood
-
power failure
-
any similar event beyond our reasonable control
If a session cannot take place due to force majeure, My Travel Pix may issue a voucher equal to the amount paid. Unless otherwise stated, vouchers are valid for 12 months from issue and may be used toward a future Photography Session, subject to availability.
If package prices, taxes, destination costs, public holiday surcharges, or other fees increase before voucher redemption, you are responsible for paying any difference.
Vouchers are not redeemable for cash unless required by law.
17. Cancellation and Refund Policy
If you need to cancel your booking, you must notify My Travel Pix in writing.
Refunds are calculated based on the amount paid for the Photography Session, excluding non-recoverable transaction fees, bank fees, card fees, currency conversion fees, taxes, third-party costs, permits, location fees, and any other non-refundable costs.
Unless otherwise stated in writing:
17.1 Cancellation more than 15 days before the session
My Travel Pix may offer either:
-
a 90% refund of the Photography Session fee; or
-
a substitute Photography Session, subject to availability.
17.2 Cancellation 7 to 15 days before the session
My Travel Pix may offer a 50% refund of the Photography Session fee.
A substitute session is not guaranteed.
17.3 Cancellation less than 7 days before the session
No refund, credit, substitute session, or compensation will be provided.
17.4 No-show
If you do not attend the session, arrive too late for the session to reasonably proceed, or fail to communicate cancellation, the booking will be treated as a no-show and no refund will be provided.
17.5 Refund recipient
Any refund will be processed back to the original payer or original payment method where possible.
18. Complaints and Service Concerns
If you have any concern during the Photography Session, you must raise it with the Photographer and/or My Travel Pix as soon as reasonably possible.
This includes concerns about:

posing
-
route
-
locations
-
pace
-
lighting
-
weather
-
crowds
-
timing
-
communication
-
Photographer approach
-
general session experience
Raising concerns during the session gives the Photographer an opportunity to make reasonable adjustments.
If you do not raise concerns during the session, My Travel Pix may be limited in its ability to address them later.
19. No Refunds for Subjective Dissatisfaction
Photography is creative and subjective.
My Travel Pix and its Photographers will use reasonable professional skill and care, but we do not guarantee that the final images will match your personal taste, expectations, aesthetic preferences, editing preferences, pose preferences, or subjective opinion.
No refund, partial refund, discount, credit, reshoot, compensation, chargeback, or other financial remedy will be provided solely because you are dissatisfied with:

artistic style
-
image selection
-
composition
-
posing
-
colour grading
-
editing style
-
retouching
-
lighting conditions
-
crowd levels
-
weather conditions
-
time of day
-
location appearance
-
facial expressions
-
clothing choices
-
hair or makeup
-
participant cooperation
-
child behaviour
-
personal preference regarding the final photographs
You are responsible for reviewing available portfolios, sample images, package descriptions, and style references before booking.
Any special editing, retouching, image manipulation, privacy, composition, or delivery requests must be made in writing before the session and must be accepted by My Travel Pix in writing. Additional fees may apply.
20. Image Selection, Editing and Delivery
After the Photography Session, the Photographer or My Travel Pix will select and edit images according to the package purchased.
Image selection, editing, colour grading, cropping, retouching, and post-production are performed according to professional judgment and My Travel Pix’s quality standards.
Unless expressly agreed in writing, clients do not choose the unedited images to be edited and do not receive RAW files or unedited files.
My Travel Pix will provide edited images through a private online gallery or other digital delivery method.
Delivery timeframes may vary depending on destination, season, workload, package type, editing requirements, public holidays, and operational factors.
21. Online Gallery Access
Your edited images will be delivered through an online gallery or digital platform.
The gallery will remain available for the period included in your package, which may be 3 months, 6 months, or 12 months, depending on the package purchased.
After the gallery expires, My Travel Pix may, at its discretion and subject to file availability, re-upload or reactivate the gallery for an administrative fee of USD 50.
You are responsible for downloading and safely storing your images before the gallery expires.
My Travel Pix does not guarantee indefinite storage of your images.
22. Sharing Gallery Links
You may share your online gallery link at your own discretion.
If you share the link publicly or privately, you understand that third parties may access, view, download, copy, save, repost, distribute, or misuse the images.
My Travel Pix is not responsible for privacy breaches, unauthorised downloads, reposts, misuse, or distribution caused by your sharing of gallery links, passwords, access details, or downloaded images.
23. Additional Fees and Third-Party Costs
Unless otherwise agreed in writing, you are responsible for costs connected to your session, including:

venue entry fees
-
attraction tickets
-
photography permits
-
location hire fees
-
transport costs during the session
-
parking fees
-
tolls
-
food and drink
-
activity costs
-
styling costs
-
makeup or hair services
-
outfit hire
-
props
-
private guide costs
-
any cost required for the Photographer to access or photograph you at the chosen location
If the Photographer must pay to enter a venue, use transport, access a location, or participate in an activity in order to photograph you, you are responsible for covering the Photographer’s reasonable related cost unless otherwise agreed in writing.
24. Promotional Offers
My Travel Pix may offer promotional codes, special offers, discounts, or limited-time promotions.
Promotions:

must be used before their expiry date;
-
cannot be applied after payment unless we agree in writing;
-
cannot usually be combined with other promotions;
-
may be limited to one use per person or booking;
-
may be withdrawn or changed at any time;
-
have no cash value unless required by law.
My Travel Pix may verify, refuse, cancel, or remove promotional codes or discounts if used incorrectly, fraudulently, after expiry, or contrary to promotion terms.
25. Gift Cards
My Travel Pix may offer gift cards where available.
Gift cards:
-
may be used only for eligible My Travel Pix Services;
-
are not redeemable for cash unless required by law;
-
may not be resold without written permission;
-
may not be used to purchase other gift cards;
-
are subject to availability;
-
may require payment of any balance if the selected service exceeds the gift card value.
Unless otherwise stated, My Travel Pix gift cards are valid for 12 months from the date of purchase, subject to applicable law.
Lost, stolen, expired, misused, or unauthorised gift card codes may not be replaced unless required by law.
Gift card refunds and cancellation rights may vary depending on applicable consumer law and the circumstances of purchase.
26. Insurance and Assumption of Risk
You participate in Photography Sessions at your own risk.
Photography Sessions may involve travel, walking, stairs, uneven surfaces, beaches, water areas, cliffs, roads, public spaces, crowds, vehicles, weather exposure, animals, venues, or other risks.
You are responsible for considering your own health, fitness, mobility, safety, travel plans, children, dependants, belongings, and insurance needs.
My Travel Pix strongly recommends that you obtain appropriate:

travel insurance
-
health insurance
-
cancellation insurance
-
weather disruption cover
-
personal property insurance
-
liability insurance, where relevant
My Travel Pix is not responsible for loss, injury, illness, accidents, travel disruption, theft, property damage, third-party claims, or other losses arising during your trip or Photography Session except to the extent required by law.
27. Photographer and Third-Party Responsibility
Photographers are independent service providers.
Third parties such as venues, transport providers, print suppliers, payment platforms, gallery platforms, accommodation providers, guides, stylists, makeup artists, or activity providers operate independently of My Travel Pix.
My Travel Pix is not responsible for the acts, omissions, negligence, delays, failures, products, services, representations, policies, or conduct of independent Photographers or Third Parties except to the extent required by law.
If you purchase or use services from a Third Party, that relationship is between you and the Third Party.
28. Limitation of Liability
To the maximum extent permitted by law, My Travel Pix is not liable for:

indirect loss

loss of profit
-
loss of business
-
loss of opportunity
-
loss of enjoyment
-
loss of data
-
loss of goodwill
-
travel costs
-
accommodation costs
-
missed flights
-
missed events
-
emotional distress
-
consequential loss
-
losses caused by third parties
-
losses caused by events beyond our reasonable control
If My Travel Pix is found liable for breach of these Terms, our total liability is limited to the amount you paid to Golden Hour Diary for the relevant Photography Session, except where such limitation is not permitted by law.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, statutory rights, or remedies that cannot lawfully be excluded under Australian Consumer Law or other applicable law.
29. Disclaimer
My Travel Pix provides its Website and Services on an “as available” basis.
We do not guarantee that:

the Website will always be available;
-
online galleries will be uninterrupted;
-
emails will always be received;
-
particular Photographers will be available;
-
particular locations will be accessible;
-
weather will be suitable;
-
images will match sample photographs;
-
every requested image, pose, angle, or moment will be captured;
-
third-party platforms will operate without interruption.
Any information, images, examples, itineraries, location descriptions, or promotional material provided by My Travel Pix are for general guidance only.
30. Intellectual Property and Copyright
Copyright in photographs is generally owned by the Photographer or My Travel Pix, depending on the arrangement between Golden Hour Diary and the Photographer.
By purchasing a Photography Session, you receive a personal, non-exclusive licence to use the delivered edited images for personal, non-commercial purposes.
Unless otherwise agreed in writing, you may:

download the delivered images;
-
print the delivered images for personal use;
-
share the delivered images with family and friends;
-
post the images on personal social media accounts;
-
use the images in personal albums, gifts, and non-commercial keepsakes.
You may not, without written permission:
-
sell the images;
-
license the images to third parties;
-
use the images for commercial advertising;
-
use the images as a trademark or logo;
-
enter the images into commercial campaigns;
-
edit, alter, or manipulate the images in a derogatory or misleading way;
-
claim copyright ownership;
-
remove watermarks, credits, metadata, or copyright notices where applied;
-
provide the images to brands, hotels, tourism boards, media outlets, or commercial entities for promotional use.
If you want to use images for commercial purposes, business branding, influencer campaigns, sponsored content, media publication, or advertising, you must request a commercial licence in writing. Additional fees may apply.
31. Promotional Use of Images
Unless you notify My Travel Pix in writing before the Photography Session, you grant My Travel Pix and the Photographer permission to use selected images from your session for portfolio, website, social media, advertising, editorial, promotional, award, educational, and marketing purposes.
This permission is worldwide, royalty-free, non-exclusive, and ongoing.
You may withdraw this permission by notifying My Travel Pix in writing. Withdrawal will apply to future use where reasonably practical, but may not affect materials already printed, published, distributed, archived, shared, indexed, or used before withdrawal.
If you require privacy, confidentiality, non-publication, child privacy restrictions, or image-use limitations, you must advise My Travel Pix in writing before the Photography Session.
32. Children and Minors
If children or minors participate in a Photography Session, the booking adult confirms that they are the parent, guardian, or authorised responsible adult, or that they have obtained all required permissions.
The responsible adult must supervise children at all times.
My Travel Pix and the Photographer are not responsible for childcare, child supervision, child safety, behaviour management, or decisions made by parents or guardians during the session.
If a child is unwell, distressed, tired, unwilling to participate, or unable to cooperate, the Photographer will use reasonable efforts to work gently and professionally, but no specific image outcome is guaranteed.
33. Privacy and Personal Information
My Travel Pix may collect personal information needed to provide Services, including names, contact details, booking details, travel dates, payment information, image preferences, participant details, and session-related information.
We may use personal information to:

process bookings;
-
communicate with you;
-
coordinate Photographers;
-
deliver galleries;
-
manage payments;
-
provide customer support;
-
improve Services;
-
comply with legal obligations;
-
send relevant service communications.
My Travel Pix will handle personal information in accordance with applicable privacy laws and any privacy policy published by us.
34. Website Use
You must not misuse our Website or Services.
You agree not to:

interfere with the Website’s operation;
-
attempt unauthorised access;
-
copy website content for commercial purposes;
-
scrape or harvest data;
-
upload malicious code;
-
impersonate another person;
-
misuse booking systems;
-
infringe intellectual property rights;
-
use the Website unlawfully.
We may suspend or refuse access to Services if we believe you have breached these Terms.
35. Third-Party Links
Our Website, emails, galleries, or social media may include links to third-party websites, platforms, payment processors, booking tools, maps, accommodation providers, venues, print suppliers, or social media platforms.
My Travel Pix does not control third-party websites and is not responsible for their content, terms, privacy practices, security, availability, pricing, or services.
You access third-party links at your own risk.
36. Changes to Services or Terms
My Travel Pix may change, suspend, withdraw, or update its Website, Services, packages, prices, inclusions, policies, or Terms & Conditions at any time.
Updated Terms will apply from the time they are published or otherwise provided.
Bookings already confirmed and fully paid will generally remain subject to the Terms in place at the time of booking, unless changes are required by law, safety, operational necessity, or mutual written agreement.
37. Indemnity
You agree to indemnify My Travel Pix, its owners, employees, contractors, Photographers, agents, and representatives against claims, losses, damages, liabilities, costs, and expenses arising from:

your breach of these Terms;
-
your misuse of the Services;
-
your conduct during a Photography Session;
-
your failure to supervise children, pets, or participants;
-
your breach of third-party venue rules;
-
your unauthorised commercial use of images;
-
claims made by participants or third parties connected to your booking;
-
your failure to obtain required permissions or consents.
This clause survives completion, cancellation, or termination of your booking.
38. Termination or Refusal of Service
My Travel Pix may refuse, suspend, cancel, or terminate Services where we reasonably believe:

you have breached these Terms;
-
payment is disputed, reversed, fraudulent, or incomplete;
-
your conduct is unsafe, abusive, discriminatory, threatening, or inappropriate;
-
the session cannot be performed safely;
-
the booking involves unlawful activity;
-
Photographer safety is at risk;
-
you have provided false or misleading information.
If Services are terminated due to your breach or conduct, no refund may be payable.
39. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be read down or removed to the extent necessary, and the remaining Terms will continue to apply.
40. No Waiver
If My Travel Pix does not enforce a right under these Terms, that does not mean we waive that right.
Any waiver must be in writing to be effective.
41. Assignment
You may not assign or transfer your rights or obligations under these Terms without written consent from My Travel Pix, except where a booking transfer is approved under these Terms.
My Travel Pix may assign or transfer its rights and obligations where reasonably necessary for business, operational, legal, or restructuring purposes.
42. Entire Agreement
These Terms, together with your booking confirmation, invoice, package description, and any written agreement from My Travel Pix, form the entire agreement between you and My Travel Pix regarding the Services.
Any verbal discussions, informal messages, social media statements, promotional examples, or previous communications do not override these Terms unless confirmed in writing by My Travel Pix.
43. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of New South Wales, Australia.
You agree that any dispute, claim, proceeding, or legal issue arising out of or connected with these Terms, the Website, or the Services will be subject to the courts and tribunals of New South Wales, Australia, subject to any mandatory consumer law rights that may apply.
